AFP and ONP: Government Eliminates Contribution Requirement for Independent Workers

The Government has implemented a significant change in the pension system by eliminating the obligation for independent workers to contribute to the AFP and ONP. According to the approved supreme decree, this measure will come into effect in 2028, allowing contributions to be completely voluntary for this group. The regulation, which responds to modifications introduced by Law No. 32445, also establishes that mandatory affiliation will remain only for dependent workers. They must choose their pension system—either the National Pension System or the Private Pension System—within 10 days of starting their employment. Additionally, Decree No. 061-2026-EF redefines key aspects such as the “insurable income,” applicable only to those making voluntary contributions. The responsibility of employers is also reinforced, as they must verify the affiliation of their workers or face penalties for non-compliance.
