Indecopi: Airlines Must Compensate Passengers for Overbooking During Holy Week

The National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) has warned airlines about the compensation they must provide to passengers affected by flight overbooking during the upcoming Holy Week. Although this practice is not illegal, companies are required to compensate travelers with a minimum of 25% of the cost of the unused segment if they are denied boarding.

In addition to monetary compensation, airlines must offer passengers the option of immediate reimbursement or rebooking of their flight. Indecopi also reminded that in cases of delays attributable to the companies, they must provide snacks, access to free calls, meals, and, if necessary, accommodation and transportation, depending on the length of the delay.

This year, the airline sector has been one of the most sanctioned, accumulating 2,072 violations between 2022 and 2025, mainly for non-compliance with refunds and boarding denials.
