2026 Elections: Rights of Poll Workers and How They Should Be Applied

On April 12, general elections will take place in Peru, where citizens will elect their new president, vice presidents, congress members, and representatives to the Andean Parliament. In this regard, the question arises about the rights of poll workers, who are entitled to a paid day off according to the Organic Law of Elections (Law No. 26859). This time off is non-negotiable and not optional for companies. The regulation states that they must grant this benefit as long as the worker presents proof of their participation. Denying this right can lead to administrative penalties and jeopardize the company’s labor reputation, warns Daniel Abusabal, country manager of Talana in Peru. Although some organizations attempt to coordinate with employees on when to take this day off, this does not imply its elimination. Companies must integrate these obligations into their operational planning, considering that electoral processes are predictable events. Complying with the regulation is not only a legal duty but also part of a management strategy that reflects organizational maturity.
